FluxForce as Controller and Data Processor

FluxForce acts as the data controller for personal data collected directly from users and clients through its website, contact forms, registration processes, subscriptions, and its own marketing communications.

FluxForce also acts as the data processor for personal data that clients upload to the platform as part of their use of the contracted services, in accordance with the Data Processing Agreement (“DPA”), which forms an integral part of the Contract terms and conditions.

FluxForce's roles in data processing

Depending on the type of data and the context of the processing, FluxForce may act as:

a) The Data Controller, with respect to the personal data of users, clients, and potential clients who interact directly with FluxForce through the website, forms, registration processes, billing, support, and its own marketing communications.

b) The Data Processor, with respect to the personal data that Clients choose to incorporate into the FluxForce platform within the framework of the Service provision, with the Client being the Data Controller of said data.

Collection of Contacts’ Personal Information to fulfill our contractual obligations as a service provider to the Customer

FluxForce’s Services enable Customers to promote their brands through email, SMS, chat, and other types of marketing communications.

Customers may choose to input their Contacts’ Personal Information into the Services to send them marketing communications. FluxForce collects Contacts’ Personal Information to fulfill our contractual obligations as a service provider to the Customer. A Customer’s processing of Contacts’ Personal Information via the Services is subject to the Customer’s privacy practices, not ours.

FluxForce is not responsible for any Customer’s compliance with applicable privacy laws, or a Customer’s obligations related to their Contacts’ privacy rights.

Recipients of your personal data

Personal data may be processed by FluxForce and, when necessary for the proper provision of the Service, by suppliers and collaborators acting as data processors, such as providers of technological infrastructure, hosting services, communication tools, or payment processors.

All these third parties operate under contracts that guarantee compliance with Regulation (EU) 2016/679 (GDPR) and will only process data following instructions from FluxForce or the Client, as applicable.

Under no circumstances will personal data be transferred to third parties for marketing purposes without the express consent of the data subject.
