Contract terms and conditions
1. Purpose of the agreement
By subscribing to the FluxForce platform service (hereinafter, the “Service”), the Client gains access to the use of the platform in accordance with the selected Plan (Free, Starter, Growth, or Premium) and the functionalities described for said Plan on the Service’s pricing page.
2. Duration
Subscriptions to the Service may be contracted on a monthly or annual basis. Each subscription shall have an initial duration of one (1) month or one (1) year, depending on the period selected, and will automatically renew for successive periods of the same duration, unless either party notifies the other of its intention not to renew at least thirty (30) days prior to the expiration date of the current period.
3. Commitment Period
The Client may cancel the Service at any time, without any minimum commitment period. Once the cancellation is exercised, the Service will remain active until the end of the period already paid for and will not automatically renew thereafter.
4. Pricing and billing
The price of the selected Plan will be that which is in effect at the time of subscription or renewal and will be charged using the payment method provided by the Client. In the event of a price change, FluxForce will notify the Client at least thirty (30) days in advance.
5. Features and scope
The Service will be provided in accordance with the functions described for each Plan on the pricing page. The Client acknowledges that the correct operation of certain functionalities may depend on third-party integrations, configurations performed by the Client, or limitations inherent to the selected Plan.
6. Updates and Improvements
FluxForce may introduce updates, enhancements, or modifications to the Service without requiring additional consent, provided that the Client is informed of such changes and the core functionality of the subscribed Plan is not substantially reduced.
7. Cancellation, data export, and service termination
In the event of cancellation, the Client may export their data from their account while the Service remains active. Once the paid period has expired and the subscription is not renewed, the account will transition to read-only mode or be deleted after an internal retention period determined by FluxForce, in accordance with its Privacy Policy (Article 17 GDPR) regarding data erasure.
8. Liability, support, and warranty
FluxForce will provide technical support according to the subscribed Plan and will make every effort to ensure Client satisfaction. However, unless expressly agreed in writing, FluxForce shall not be held responsible for any commercial results or return on investment derived from the Client’s use of the Service.
9. Governing law and jurisdiction
This agreement shall be governed by Spanish law. For any disputes arising from it, the parties expressly submit to the Courts and Tribunals of the city of Girona, except where mandatory applicable law provides otherwise.
10. Acceptance
Subscribing to the Service implies full acceptance of these Terms and Conditions, as well as the Legal Warning and Privacy Policy, all of which are duly published on the FluxForce website.
